| چکیده | ||
| با آنکه قوانین و مقررات در همه نظام‌های حقوقی به طور معمول برای وضعیتهای عادی تدوین، تصویب و منتشر می‌شوند، اما در این میان گاه وضعیت‌هایی بر نظام‌های سیاسی حادث می‌شود که حیات اجتماع را در مخاطره قرار می‌دهد. برای مدیریت این وضعیتهای مخاطره‌انگیز، ابزارهای مختلفی در نظام‌های سیاسی وجود دارد که یکی از آنها، اعلام وضعیت اضطراری است. در وضعیت اضطراری، محدودیت‌هایی نسبت به حقوق و آزادی‌های اساسی، همچون حق بر رفت‌وآمد، حق بر اشتغال و آزادی رسانه‌ای بار می‌شود. با توجه به اینکه حقوق و آزادی‌های اساسی مردم در وضعیت اضطراری در معرض تحدید قرار می‌گیرد، رعایت یکسری قواعد شکلی و ماهوی از جانب دولت‌ها الزامی است تا این وضعیت، منجر به نقض اساسی حقوق و آزادی‌های بنیادین نشود. با شیوع بیماری کووید 19 در سرتاسر جهان، برخی از کشورها به اعلام وضعیت اضطراری بهداشتی پرداختند تا از این طریق بتوانند به مقابله با این بیماری بپردازند. در ایران هر چند به طور رسمی از ظرفیت‌های اصل 79 قانون اساسی استفاده نشد و وضعیت اضطراری اعلام نشد، با استفاده از اصل 176 قانون اساسی محدودیت‌هایی بر برخی از حقوق و آزادیها وارد شد. بررسی فرایند اعمال این محدودیت‌ها در ایران نشان می‌دهد که الزامات شکلی و ماهوی ناظر بر وضعیتهای اضطراری تا حدود زیادی رعایت شده است. | ||

| Although laws and regulations in all legal systems are typically formulated, enacted, and promulgated for ordinary situations, sometimes situations arise for political systems that endanger the life of society. To manage these dangerous situations, there are various tools in political systems, one of which is to declare a state of emergency. In such cases, restrictions on fundamental rights and freedoms, including the right of movement, the right to employment and the freedom of the media, are imposed. Given that the fundamental rights and freedoms of the people are restricted in a state of emergency, it is imperative that governments adhere to a set of formal and substantive rules so that this situation does not lead to a fundamental violation of fundamental rights and freedoms. With the spread of Covid 19 disease around the world, some countries have declared a health emergency in order to deal with the disease. In Iran, although the capacities of Article 79 of the Constitution were not formally used and a state of emergency was not declared, the use of Article 176 of the Constitution imposed restrictions on some rights and freedoms. An examination of the process of applying these restrictions in Iran shows that the formal and substantive requirements for emergency situations have been met to a large extent. | ||
