| تأثیر شیوع بیماریهای فراگیر بر اجرای تعهدات حقوق بینالملل بشردوستانه: بررسی وضعیت ناشی از ویروس کرونای جدید (کووید-19) علی اکبر سیاپوش چکیده رابطه ی میان وضعیت های مخاصمۀ مسلحانه و وضعیت های ناشی از شیوع بیماری های فراگیر موجب طرح این مسئله میگردد که اجرای تعهدات حقوق بشردوستانه چگونه و تا چه حد تحت تأثیر بروز چنین وضعیتهایی قرار میگیرد. قواعد بشردوستانه که هدف اصلی آن حمایت از اشخاص و اشیای تحت حمایت از طریق قاعدهمند نمودن هدایت مخاصمه و محدود کردن طرفهای مخاصمه در انتخاب ابزار و روش جنگی است، لزوم بازبینی در تصمیماتی با ماهیت صرفاً نظامی را به دلیل الزامات ناشی از حقوق بینالملل بشردوستانه در وضعیتهای ناشی از بیماریهای فراگیر خصوصاً در مورد کادر درمانی و پزشکی بیمارستانها و مراکزی که علیرغم کاربرد دوگانه تأثیری مستقیم در مقابله با بیماری دارند، به همراه دارد کلیدواژگان: حقوق بینالملل بشردوستانه، مخاصمات مسلحانه، ویروس کرونا، کووید-19، حمایت از غیرنظامیان | ||

| The link between armed conflict and epidemic-related conditions begs the question of how and to what degree the implementation of the International humanitarian law commitments is influenced by the presence of such circumstances. Humanitarian norms, whose principal objective is to protect individuals and objects by regulating the conduct of hostilities and limiting the parties to the conflict in their choice of means and methods of warfare, require a review of purely military judgments in the situations resulting from widespread diseases, particularly in the case of medical personnel working in hospitals and centers who, despite their dual purpose, have a direct impact on the fight against the disease. | ||
