| در تاریخ پرفرازونشیب سلامت عمومی در جهان، ظهور و باز ظهور بیماری‌های عالمگیر به‌عنوان یکی از واقعیات حیات اجتماعی به اقتضای زمینه و زمانۀ خود، بارها تمدن‌های بشری را آزار داده است. شیوع پرشتاب این بیماری‌ها در گسترۀ جهانی بدون احترام به منزلت مرزهای ملی، ثمرۀ طبیعی و نتیجۀ منطقی هزاران نوع همبستگی و وابستگی متقابل میان دولتها و ملت‌هاست. گسترش کووید-19 در ابتدای دهۀ سوم قرن بیست و یکم و واکنش‌های متفاوت دولتها در مواجهه با انتشار این بیماری در قلمرو سرزمینی آنها، حکایت‌گر تشتتی حیرت‌انگیز برای مقابله با این ویروس سر به طغیان برداشته است. امروزه تردیدی وجود ندارد که هرگونه اقدام مؤثر برای کنترل و نابودی بیماری‌های عالمگیری همچون کووید-19، با همکاری و هماهنگی بین اعضای جامعۀ بینالمللی، ربط و اتصالی وثیق دارد. نظام حقوق بین‌الملل، نقش برجسته‌ای در تلاش‌های بینالمللی برای کنترل بیماری‌های مسری و عالمگیر ایفا نموده است. اگرچه جنبه‌های متعدد و پیچیدۀ رابطه بین نظام حقوق بین‌الملل و بیماری‌های عالمگیر، طیفی از رژیم‌های حقوقی مختلف را درگیر خود نموده است، با اندکی تأمل می‌توان تقارب و تلاقی بین الزامات آنها را احراز نمود. مقالۀ حاضر درصدد تدارک پاسخ به این پرسش است که نظام حقوق بین‌الملل در ارتباط با کنترل بیماری‌های عالمگیر به‌ویژه کووید-19، متضمن کدام تعهدات بینالمللی است؟ یافته‌های تحقیق حاضر نشان می‌دهد که مقررات بهداشتی بینالمللی 2005 در کنار برخی قواعد موافقتنامه اِعمال اقدامات بهداشتی و بهداشت گیاهی 1994، هستۀ اصلی تعهدات بینالمللی دولتها در قبال کنترل بیماری‌های عالمگیر ازجمله کووید-19را تشکیل می‌دهد، اگرچه نقایص و کاستی‌هایی نیزدر این تعهدات وجود دارد. | ||

| In the vicissitudinous history of public health in the world, emerging and reemerging pandemic diseases as one of the realities of social life according to its context and time have repeatedly afflicted human civilizations. The rapid outbreak of these diseases on a global scale without respect for the sanctity of national borders is a natural result and the logical consequence of thousands of kinds of solidarity and interdependence between states and nations. The spread of Covid-19 at the beginning of the third decade of the 21st century, and the different reactions of states to the outbreak of this disease in the realm of their territory, indicate an astonishing dispersion to confront this insurgent virus. Today, there is no doubt that any effective measure to control and eradicate pandemic diseases such as Covid-19, has a close link with the cooperation and coordination of members of the international community. The international legal system has played a prominent role in international efforts to control contagious and pandemic diseases. Although different and complex aspects of the relationship between the international legal system and pandemic diseases have involved a range of different legal regimes, with a little contemplation one can determine the closeness and the intersection between their requirements. The present essay seeks to provide an answer to the question of what international obligations the international legal system has concerning the control of pandemic diseases, especially Covid-19. The findings of the present study show that the 2005 International Health Regulations, along with some provisions of the 1994 Agreement on the Application of Sanitary and Phytosanitary Measures, form the core of governments' international obligations to control pandemic diseases, including Covid-19, although there are shortcomings in these Obligations. | ||
