| شیوع ویروس کرونا یا کووید 19 بر عرصه‌های مختلف زندگی اجتماعی تأثیرات عمیقی برجا گذاشته است. قواعد حقوقی نیز از شیوع این ویروس بی‌نصیب نمانده‌اند. در آنچه به حقوق مالکیت فکری مربوط می‌شود، این آثار نه تنها در حیطۀ حقوق مالکیت صنعتی، بلکه در حیطۀ حقوق مالکیت ادبی و هنری نیز مشهود است. به‌ویژه در زمینۀ اختراعات دارویی، ضرورت آشتی بین مقتضیات سلامتی عمومی و حقوق انحصاری مخترعان و دارندگان اسرار تجاری مرتبط با ویروس کرونا بیش از هر زمان دیگری آشکار شده است. سازمان ملل متحد و سازمان بهداشت جهانی با صدور قطعنامه‌هایی بر ضرورت اتحاد برای دسترسی منصفانه به فناوری‌های تندرستی در مقابله با کووید 19 در همۀ نقاط جهان به مدد استفادۀ مشترک از دانش، اموال مالکیت فکری و داده‌ها تأکید می‌کنند. در این راستا، برخی حقوقدانان لزوم استفاده از سازوکار بهرهبرداری اجباری (لیسانس اجباری) و سایر مستثنیات حقوق مادی مخترعان و دارندگان اسرار تجاری را توصیه می‌کنند. از دیگر آثار کووید 19 بر حقوق مالکیت صنعتی و تجارتی، تمدید مهلت‌های مرتبط با حقوق مالکیت صنعتی و پاسخگویی به ادارۀ اختراعات تا رفع وضعیت اورژانس است. در حیطۀ مالکیت ادبی و هنری، جز در مورد نرم‌افزارها و پایگاه‌های داده علاوه بر استفاده از مستثیات حقوق مادی پدیدآورندگان، توجهات عمدتاً به آثار نمایشی و کمک‌های مالی به اجراکنندگان این آثار است که به دلیل شیوع کرونا از برگزاری مستقیم و عمومی هنرهای نمایشی و نتایج اقتصادی آن محروم شده‌اند. کووید 19، ویروس کرونا، کووید 19، حقوق مالکیت فکری، حقوق مالکیت صنعتی و تجارتی، حقوق مالکیت ادبی و هنری، | ||

| The outbreak of Coronavirus or Covid-19 has had profound effects on various areas of social life. Legal rules have not been spared from the spread of the virus. As far as intellectual property rights are concerned, these works are evident not only in the field of industrial property rights, but also in the field of literary and artistic property rights. Especially in the field of pharmaceutical inventions, the need for reconciliation between the public health requirements and the exclusive rights of inventors and trade secrets associated with the coronavirus has become more apparent than ever. The United Nations and the World Health Organization (WHO) have issued resolutions emphasizing the need for unity in equitable access to health technologies against Covid-19 in all parts of the world through the shared use of knowledge, intellectual property and data. In this regard, some jurists recommend the need to use the mechanism of compulsory exploitation (compulsory license) and other exceptions to the economic rights of inventors and trade secret owners. Other works of Covid-19 on industrial and commercial property rights include extending the deadlines related to industrial property rights and responding to the Patent Office until the state of emergency is resolved. In the field of literary and artistic property, except for software and databases, in addition to using the exceptions of the economic rights of creators, the focus is mainly on dramatic works and financial aid to their performers who are deprived of economic interests based on the pandemics. | ||
