مسئولیت بینالمللی دولتها در کمکرسانی انساندوستانه: با تاکید بر موضوع شیوع ویروس کوئید- 19 | ||

| چکیده | ||
| شیوع ویروس کرونا که ابتدا از استان ووهان چین آغاز گردید و در کمتر از یازده هفته، تمام جهان را آلوده کرد، یکی از مهم‌ترین چالش‌های ایجاد شده بر سلامت و امنیت انسانی بعد از جنگ دوم جهانی بوده است. باوجودآنکه وظیفۀ اصلی و اساسی تأمین سلامت و حداقل معیشت زندگی انسانی بر عهدۀ دولت متبوع و محل سکونت انسان‌هاست، آثار و ابعاد مختلف اقتصادی، اجتماعی و بهداشتی شیوع ویروس کرونا بر زندگی انسان‌ها، ضرورت کمکرسانی انساندوستانه از سوی تمامی دولتها را ایجاب می‌کند. سوال اساسی این مقاله این است که آیا تعهدی عرفی برای دولتها در کمکرسانی به یکدیگر به منظور مبارزه با شیوع ویروس کرونا و پیامدهای اقتصادی، بهداشتی و اجتماعی ناشی از آن وجود دارد؟ فرضیۀ نگارنده این است که تعهدی عرفی برای دولت‌های توانگر برای کمک به دولت‌های آسیب‌پذیر در مبارزه با ویروس کوئید-19 وجود دارد. به‌ویژه آنکه ناتوانی و شکست یک دولت در مبارزه با این ویروس، به تکثیر و شیوع آن به دولت‌های همسایه و ماورای آن نیز خواهد انجامید و منافع تمامی دولتها در این است که مبارزه با این ویروس را به مرزهای ملی و داخلی خود محدود نکنند | ||

| The outbreak of coronavirus, which first started in Wuhan province of China and infected the whole world in less than eleven weeks, has been one of the most important challenges to human health and safety since World War II. Although the main task of ensuring the health and minimum livelihood of human life is the responsibility of state and the place of human habitation, the various economic, social and health effects of the coronavirus on human life necessitate humanitarian assistance from all states. The main question of this article is whether there is a customary obligation for states to help each other in combating the spread of the coronavirus and its economic, health and social consequences. The author's hypothesis is that there is a customary obligation for affluent states to assist vulnerable states in combating the Quaid-19 virus. In particular, the inability and failure of a state to fight the virus will lead to its proliferation and spread to neighboring states and beyond, and it is in the interest of all states not to limit the fight against the virus to their national and internal borders. | ||
