| تأثیر کرونا ویروس بر مسئولیت مدنی متعهدین رسول ملکوتی چکیده آغازین روزهای سال 2020 میلادی مصادف شد با همه‌گیری ویروسی مهلک با عنوان کرونا که یکی پس از دیگری کشورهای جهان را درنوردید. اگر چه علم پزشکی در مصاف لحظه‌ای با آن است، تأثیراتی که این ویروس ناشناخته بر تمامی شئونات بشر باقی گذاشته یا خواهد گذاشت، نیز از مستحدثاتی است که باید سایر رشته‌های علوم نسبت به تعیین تکلیف آن اقدام نمایند. یکی از این مسائل، تبعات مربوط به عدم یا تأخیر اجرای تعهدات ناشی از کاهش تردد و تعطیلی مراکز یا اجتماعات است. در این مقاله سعی شده است ضمن شناسایی ماهیت حقوقی این بیماری، بررسی گردد که آیا این ماهیت بر مفهوم معاف‌کنندۀ قوۀ قاهره تطبیق دارد یا خیر. در پایان مسئولیت مدنی دولت نسبت به جبران خسارات جانی و مالی وارده بر شهروندان امکان‌سنجی شده است. کلید واژگان: ویروس کرونا، مسئولیت مدنی، قوۀ قاهره، عذر عمومی، دولت. | ||

| The early days of 2020 coincided with a deadly virus outbreak called Corona that swept through the world one after another. Although medical science is at odds with it for a moment, the effects that this unknown virus has left or will have on all human beings are also innovations that other disciplines must take action to determine. One of these issues is the consequences of not having or delaying the implementation of obligations due to reduced traffic and closure of centres or communities. In this article, while identifying the legal nature of this disease, it is tried to examine whether this nature applies to the concept of exemption of the Force Majeure or not. Finally, the government's civil liability for compensation for civilian and financial losses to citizens has been assessed. | ||
