| چکیده | ||
| ویروس کرونا در ژانویه 2020 با سرعتی حیرت‌آور مرزهای ملی چین را درنوردید و در مدت شش ماه بخش گسترده‌ای از جهان را آلوده ساخت. در واقع، شیوع بیماری‌های مسری و فراگیر در جهان بی‌سابقه نیست، بااین‌حال، بشر معاصر، کمتر در خاطر دارد که چنین هراس‌آلود و مضطرب، اقتصاد، صنعت، توریسم، سیاست، ورزش و حتی امور روزمره را متأثر از رخدادی جهانی تعطیل کرده و مغلوب ویروسی ناشناخته شده باشد. متعاقب کرونا، گرچه برای مدتی چرخۀ مرسوم زندگی بشر از حرکت شتاب‌آلود و افسارگسیخته‌اش بازماند، ضرورت بازاندیشی در مقولات مهمی چون سلامت و بهداشت عمومی، همکاری و همبستگی در مقابله با پیامدهای ناگوار ناشی از آن را به بشر گوشزد کرد. این مقاله درصدد است تا با تمرکز بر شیوع کرونا، به تحلیل حقوقی مقررات بهداشتی بینالمللی (2005) مصوب سازمان جهانی بهداشت و جایگاه آن در نظام بینالمللی حقوق بشر بپردازد. بی‌تردید، حقوق بینالملل، مگر در پرتو ائتلافی جهانی در مقابله با این قسم از بحران‌های بینالمللی نخواهد توانست از ورطه‌های هولناکی چون شیوع کرونا، به سلامت بگذرد. | ||

| The coronavirus crossed China's national borders in January 2020, rapidly infected a large number of countries in less than six months. Indeed, the outbreak of infectious diseases is not unprecedented in the world, yet, the harmful effects of such a dangerous virus on economy, industry, tourism, politics, sports, and even routine life caused serious challenges for states and other actors at both national and international levels. As a result, it is time to reconsideration the ways of facing and managing pandemics by focusing on existing legal system to find the gaps and to provide the efficient ways of dealing with such severe challenges of international law. Thus, this article seeks to provide a legal analysis of the International Health Organization Regulations (2005) by focusing on capacities, regulations and loopholes of the document to find its legal status in the international human rights system. Certainly, in this critical context, a universal coalition between international organizations and states, a global cooperation among all actors as well as a well-organized legal framework should be considered as the last resolution for international community to survive. | ||
