| بحران وضعیت ناشی از ویروس کرونا که از اواخر سال ۲۰۱۹ میلادی از شهر ووهان چین شروع شد، محدود به آن منطقه نماند و با گسترش روزافزون به عنوان یک پاندمی در مقیاس جهانی شناخته شد. خطرات بهداشتی این ویروس در مقایسه با ویروس‌های مشابه خیلی گسترده بود؛ به نحوی که هم‌اکنون نیز تعداد زیاد بیماران در کنار تعداد پر شمار قربانیان، آینده‌ای همراه با نگرانی را به همراه دارد. در این شرایط، مقامات عمومی شامل دولت، مجلس و سایر مقامات و نهادهای عمومی فرانسه تدابیر و تصمیماتی را در خصوص شرایط و اوضاع و احوال مذکور اتخاذ نمودند. تمام اقدامات صورت گرفته یا پیش‌بینی شده بدین سبب بوده است تا نظام سلامت و بهداشت فرانسه امکان مقابلۀ بهتر وکامل‌تر، متناسب با وضعیت ویروس کرونا را که هر روز رو به گسترش بود، داشته باشند. این موضوع از منظر حقوق عمومی و بالطبع حقوق اداری چالش‌ها و مباحثی در زمینۀ نوع، محدودۀ تدابیر و نیز مبانی حقوقی ایجاد وضعیت اضطراری سلامت در میان جامعۀ حقوقدان‌ها به وجود آورد و دولت فرانسه نیز با ابهام و تردیدهایی در طی این مسیر سخت روبرو بود و مبانی حقوقی مستحکم‌تری را جستجو می‌کرد. بدین منظور، دولت فرانسه علاوه بر اقدامات آیین‌نامه‌ای، در تاریخ ۱۸ مارس ۲۰۲۰ دو لایحۀ قانونی، یکی در خصوص قانون ارگانیک برای نحوۀ عمل شورای قانون اساسی در رسیدگی به دعاوی مربوط به حقوق و آزادی‌های تضمین شده در قانون اساسی و دیگری نیز راجع به قانون عادی و تحت عنوان اقدامات اضطراری برای مقابله با اپیدمی کووید ۱۹ را... | ||

| The crisis and the situation caused by the corona virus, which started in late 2019 in Wuhan, China, were not limited to that area and became increasingly known as a pandemic on a mondial scale. The health risks of this virus were so great compared to similar viruses that now a large number of patients, along with a large number of victims, have a worrying future. In these circumstances, the public authorities, including the government, the parliament and other public authorities and institutions of France, took measures and decisions regarding mentioned circumstances.All the measures taken or anticipated have been designed to allow the French health system better copeing with the growth of the coronavirus. from the point of view of public law and, of course, administrative law, this issue has given rise to challenges and debates in the area of the type, scope of measures and also the legal basis for creating a health emergency within the legal community. The governement was looking for a stronger juridic base.To this end, on March 18, 2020, in addition to the legislative measures, two bills, one on the organic law on the conduct of the Constitutional Council in the processing of complaints related to the rights and freedoms guaranteed by the Constitution, and the other on Common law, under the title of emergency measures to deal with the epidemic, was presented to the French Senate, which has become the legal basis for government action in the next steps. | ||
