چکیده
فضای سایبر و فعالیت‌هایی همچون عملیات‌های سایبری که در آن انجام می‌گیرند، یکی از چالش‌های نوپدیدی است که فراروی حقوق بین‌الملل کنونی قرار گرفته. بر این پایه، تبیین و تعیین مسائل مرتبط با این فضا و فعالیت‌های ذی‌ربط، از جمله از چشم‌انداز حقوق بین‌الملل، اهمیت و بایستگی انکارناشدنی دارد. یکی از موضوعات مطرح در این زمینه، موازین ناظر بر انجام عملیات‌های سایبری در دریاهاست. در این راستا، در این نوشتار تلاش شده است تا از رهگذر روش توصیفی-تحلیلی، بایسته‌های عملیات‌های سایبری در دو منطقه دریاییِ دریای سرزمینی و دریای آزاد در پرتو دستورالعمل تالین 2 راجع به حقوق بین‌الملل قابل اعمال در عملیات‌های سایبری (2017) به مطالعه در آید. نتایج این پژوهش نشان‌گر آن است که انجام عملیات‌های سایبری در مناطق یادشده، باید با اصول و قواعد کلی حاکم بر آن‌ها از چشم‌انداز حقوق بین‌الملل سازگار باشد. روی‌هم‌رفته، فضای سایبر، قلمرو یا منطقه‌ای جدید برای فعالیت‌های انسانی در چارچوب حقوق بین‌الملل به شمار نمی‌رود. از این‌رو، عملیات‌های سایبری فعالیت‌هایی سایبری محسوب می‌گردند که به‌دست انسان‌ها در زمین، دریا، هوا و فضای ماورای جو انجام می‌شوند و به این خاطر، تحت حاکمیت موازین حقوق بین-الملل قابل اِعمال بر این مناطق هستند.

چکیده [English]
Cyber space and activities such as cyber operations which are conducted in it are one of the new challenges facing the contemporary international law. Accordingly, exploration and determination of issues relating to this space and its related activities, inter alia, from the perspective of international law, has an undeniable significance and necessity. In this regard, the present study has attempted to examine the requirements of cyber operations in territorial sea and high seas in the light of 2017 Tallinn Manual 02. The findings of this paper imply that conducting cyber operations in the said maritime zones should be compatible with the principles and rules which govern them. Generally speaking, cyber space is not a new territory or area for human activities in the framework of international law. Consequently, cyber operations are considered cyber activities which are conducted by human beings in land, sea, air and outer space and, as a result, are governed by international law standards applicable in this territories.
