چکیده
الیگارشی یا حاکمیت گروه اندکِ دارای قدرت اقتصادی، سیاسی و یا قدرت اعمال نفوذ در حاکمیت دارای سابقه طولانی در حوزه اقتصاد، حقوق و علوم سیاسی است. این گروه مخرب با اقدامات خود مفاسد گسترده‌ای را از طریق استخراج منابع عمومی به نفع خود بر جامعه تحمیل می کنند. پژوهش ها و آمار مراجع معتبر بین المللی گویای آن است که فعالیت الیگارش ها نه تنها در جوامع در حال توسعه بلکه در جوامع پیشرفته نیز در حال گسترش است. اخبار هر روزه در مورد اختلاس و دستگیری کارگزاران ارشد استانی و ملی داخل کشور نیز ضرورت دستیابی به یک سیاست جنایی متناسب در مواجهه با این پدیده مخرب را گوشزد می کند. با وجود پژوهش های ارزشمندی که در این زمینه انجام پذیرفته اما پرداختن اختصاصی به مسئله الیگارش ها در ساختارهای دموکراتیک و سیاست جنایی متناسب در مواجهه با آن مورد توجه خاصی قرار نگرفته است. از این رو پژوهش پیش رو با روش«توصیفی- تحلیلی» با تبیین چیستی، چرائی و چگونگی تشکیل مهمترین الگوهای نظام الیگارشی و نسبت آن با فساد سیاسی- اقتصادی در ساختارهای دموکراتیک به دنبال ارایه سیاست جنایی متناسب در مواجهه با این پدیده است. یافته ها بیانگر آن است نظام الیگارشی به جهت پیچیدگی و غالباً سازمان یافته، نیازمند بازنگری در سیاست جنایی تقنینی و اتخاذ سیاست جنایی افتراقی در تمامی سطوح تحقیق، تعقیب و رسیدگی قضایی در کنار به کارگیری ضابطین تخصصی به همراه استفاده از سیاست جنایی مشارکتی فعال جامعوی و نهادهای غیر رسمی است .

چکیده [English]
Oligarchy or the rule of a small group with economic-political power or the power to influence the government has a long history in the fields of economics, law and political science. With their actions, this destructive group imposes widespread corruption on the society by extracting public resources for their own benefit. Researches and statistics of reliable international authorities show that the activities of oligarchs are expanding not only in developing societies but also in advanced societies. Daily news about the embezzlement and arrest of senior provincial and national agents in the country also points out the need to achieve a proportionate criminal policy in the face of this destructive phenomenon. Despite the valuable researches that have been conducted in this field, specific addressing to the issue of oligarchs in democratic structures and appropriate criminal policy has not been given special attention. Therefore, the upcoming research with "descriptive-analytical" method by explaining what, why and how to form the most important patterns of oligarchic system and its relationship with political-economic corruption in democratic structures seeks to provide appropriate criminal policy in facing this phenomenon. The findings indicate that the oligarchic system, due to its complexity and often organized, requires a review of the legislative criminal policy and the adoption of a differential criminal policy at all levels of investigation, prosecution and judicial proceedings, along with the employment of specialized officers and the use of active community criminal policy and Non-Governmental Organization
