| چکیده | ||
| نفقه از توابع نکاح و از نتایج حسن سلوک زوجین است که تکلیفِ تأمین آن به زوج و وظیفه تخمین آن به جهت فنی بودن، به کارشناس محول شده است. در بررسی پروندههای نفقه زوجه، به ارقامی برمیخوریم که نشان از واقعیت نداشته و بر منطق موجهی استوار نیست، حال آنکه مطابق قانون، ارقام میبایست بر اساس نیازهای متعارف زوجه، عادله روز و بر پایه قاعده عدل و انصاف تنظیم شود. پرسش اصلی، منطقِ حاکم بر این مبالغ است. پژوهش حاضر که تحقیقی کاربردی است با تکیه بر روش توصیفی- تحلیلی از طریق تحقیقات میدانی، پرسشنامه و با بررسی پروندههای جاری بر پایه واقعیت موجود و البته مراعات قاعده عدل و انصاف به واکاویِ مسأله و ارائه راهکار پرداخته است. یافتهها حاکی از آن است که ارقام حاضر بیش از هر چیز با عرف کارشناسی، خواست و شرایطِ زوج و اراده مقام قضایی هماهنگ است. رویه موجود با طرح مسئولیت نیابتی، بیمه نفقه، تأسیس نهادی همچون صندوق پشتیبانی از خانواده و مداخله مطلوب دولتی میتواند مورد بازنگری قرار گیرد؛ زیرا در خوشبینانهترین حالت، نظریه کارشناسیِ فاقد پشتوانه حقیقی، مصداق گزارش خلاف واقع و تخلف انتظامی و در سختترین مواجهه، مصداق بزه جعل و متضمن ضمانت اجرای کیفری است. | ||

| Alimony is one of the functions of marriage and results of the couple's good behavior. The task of providing is assigned to the couple and the task of estimating is assigned to an expert for technicality. In examining the cases of alimony, we come across figures that neither show reality nor are based on justified logic, however, according to the law, the figures should be set based on the wife's conventional needs, the daily market price, and the fairness. The main question is the logic governing on these figures. This research which is an applied research, relying on the descriptive-analytical method, and through field research and questionnaires and by examining the cases based on the facts and observing the rule of justice and fairness, has been analyzed the problem and presented a solution. The findings indicate that present figures are in harmony with the custom of the expert, the conditions of the couple and the will of the judicial authority. This situation can be reviewed with the vicarious liability, the establishment of a family support found and favorable government intervention; because an expert’s theory without real support is an example of a policy violation and forgery. | ||
