چکیده
آداب‌التجاره در فقه اسلامی مجموعه‌ای از دستورالعمل‌ها و اصول اخلاقی است که بر رعایت صداقت، انصاف، شفافیت و اعتمادسازی تأکید دارد. در دنیای مدرن نیز، بسیاری از شرکت‌های بزرگ و موفق در سطح جهانی، به‌ویژه در راستای برندینگ و حفظ اعتماد مشتریان، کدهای اخلاقی مشابهی را به کار می‌برند. تمایز بنیادین در این است که آموزه‌های اسلامی این اصول را با هدف قرب الهی مطرح می‌کنند، درحالی‌که نظام‌های لیبرال آنها را ابزاری برای تحقق سود می‌دانند. همچنین، این اصول اخلاقی نقشی اساسی در شکل‌گیری و اجرای قواعد حقوقی دارند. این مقاله به بررسی این اصول در چارچوب چهارده محور کلیدی ازجمله سهل‌گیری در معاملات، حسن‌نیت، امنیت و اعتماد، حق بر کیفیت و مسئولیت اجتماعی پرداخته است. هدف اصلی تحقیق تحلیل تطبیقی این اصول در فقه اسلامی و مدل‌های اخلاقی مدرن است تا نشان دهد که چگونه این اصول می‌توانند به ایجاد تجارت پایدار و رقابت سالم کمک کنند. نتیجه‌گیری این تحقیق بر اهمیت پیاده‌سازی یک کد اخلاقی جامع برای موفقیت بلندمدت شرکت‌ها تأکید دارد و پیشنهادهایی برای اعمال این اصول در استراتژی‌های تجاری ارائه می‌دهد

چکیده [English]
Adab al-Tijarah (Trade Etiquette) in Islamic jurisprudence comprises a codified set of ethical guidelines and principles that emphasize honesty, fairness, transparency, and trust-building. In the modern global marketplace, many successful multinational corporations likewise adopt analogous ethical norms, particularly in branding and customer trust maintenance. A fundamental distinction is that Islamic teachings frame these principles as oriented toward divine proximity (qurb il-Ḥaqq), whereas liberal frameworks regard them as instruments for profit realization. Moreover, these ethical principles significantly influence the formation and implementation of legal rules. This article analyzes these principles across fourteen key dimensions, including leniency in transactions, good faith, security and trust, the right to quality, and social responsibility. The primary objective of this study is to conduct a comparative analysis of these principles in Islamic jurisprudence and contemporary ethical models, illustrating how they can contribute to sustainable trade and healthy competition. The conclusion underscores the importance of implementing a comprehensive ethical code for long-term corporate success and provides actionable recommendations for integrating these principles into business strategy.
