چکیده
چکیده
فضای مجازی به‌سرعت به ابزار کلیدی استیفاء حق آزادی بیان تبدیل شده است. فضای مجازی هم حق دریافت و هم حق بیان و انتشار اطلاعات، ایده‌ها و عقاید، به صورت نوشتاری یا از طریق صدا یا ویدئو، را در یک رسانه با هم ترکیب می‌کند.
فضای مجازی به موازات ایجاد دسترسی و امکان پخش حجم عظیمی از اطلاعات برای مخاطبان میلیونی تا گسترۀ همۀ افرادی که به رایانه و خط تلفن دسترسی دارند، چالش‌ها و موضوعات حقوقی جدیدی به همراه دارد که تنظیم گری صحیح و مطلوب آنها را الزامی می‌گرداند از این‌رو، در این مقاله تلاش شده است با توسل به رویکرد میانرشتهای، روشهای تنظیم‌گری آزادی بیان در دو حوزه هرزه نگاری کودکان و نفرت پراکنی را در فضای مجازی مورد بررسی و ارزیابی قرار گیرد. نتایج این تحقیق مشخص میکند روش های تنظیم گری در حال حاضر تا چه حد کارآمد است و همچنین روش موثر و کارامد برای تنظیم گری در حوزه مورد بحث چگونه باید باشد.

Abstract
Cyberspace is rapidly turning into a major tool for exercising the right of freedom. Cyberspace amalgamates in the media the right to receive and the right to release information, ideas and beliefs in the form of a written text, audio file, or a video file.
As well as providing access and enormous amounts of information to millions of audiences ac
 
ross the reach of all people with access to a computer and telephone line, new challenges and legal issues require the right and proper regulation.
Therefore, this study aims to closely examine the cyberspace content regulation in the area of the freedom of speech in two areas of child pornography and hate speech in cyberspace through an interdisciplinary approach. The results of this study indicate how efficient the current regulatory framework is and how effective and efficient the regulatory framework should be in the area under discussion.
